AMB Physio Pilates Privacy Policy and Disclaimer

Ann-Marie Ballantine (“AMB”) is a registered Physiotherapist offering Pilates classes to the general public, including classes focused on improving participants’ physical condition and mobility for playing golf. This Privacy Policy explains how AMB processes any personal data collected online, or when you visit any class location in person. Any data AMB collects is done with your permission and is only used for essential communication about classes and appointment bookings, the purchase of products and services and relevant and appropriate direct marketing designed to enhance your experience of the services AMB offers. AMB does not share your data with third parties at any time.

AMB takes your privacy seriously and is committed to ensuring that your personal data is protected. Should you be asked to provide information when registering on the booking system or website you can be assured that it will only be used in accordance with this privacy statement.

How AMB collects your data

AMB will collect your name, email address and other relevant personal data such as phone number, postal address, emergency contact, referral type, date of birth and gender (where appropriate) when you register through any of AMB’s booking systems. AMB will also ask you to complete a confidential health questionnaire to help determine your suitability for the Pilates class and make any required adjustments to help maintain safe participation.

This is necessary in order to carry out basic communication, fulfil bookings, give you the best service and to safeguard your health and wellbeing. AMB stores all data in servers and back-up servers located in the UK. The servers AMB uses and the hosting domain have a Privacy Shield certification which complies with GDPR regulations related to transferring data outside of the EU. Any data collected is used by AMB personnel only for essential communication about your bookings, purchases, reminders and class changes and in the case of class cancellations and emergencies.

Payment is made either by secure online banking transfer system to Ann-Marie Ballantine’s HSBC account. AMB does not store customer payment information digitally or in paper form and all payment information we process is encrypted.

We also collect personal data in-house through hard copy forms. This is required by AMB’s insurance company and provides essential information required to work within AMB’s professional guidelines. AMB is practicing as a Physiotherapist and therefore required by law to keep client records for seven years after last visit. These records are kept in a locked file when not in use by the client’s teacher and are only seen by AMB personnel who have direct dealings with the client’s programme or bookings.

How AMB uses your data

AMB uses email and SMS (text)/an instant messaging service such as WhatsApp as the primary form of communication with you if you are an existing customer. By completing the initial health questionnaire, you are consenting to your number being added to the Pilates WhatsApp group for class updates and booking, please e-amil Ann-Marie directly if you do not wish the join, or remove yourself once added. We also periodically send general email newsletters about products and services we offer to both existing and previous customers, or those who have directly enquired about our services or visited for taster or other events. You have the right to opt out of these at any time (see below).

How AMB protects your data

AMB will protect your digital and paper data using secure systems, for example by relying on the security of AMB’s email hosting service (GoDaddy) and password protected files on google drive and through due diligence with paper filing systems held under lock and key. We do not share your information with any third party. If you are under the care of another practitioner, be that a doctor or manipulative / physical therapist we will ask that you pass on any relevant information, rather than us speaking to them directly, unless both parties have your express permission.

Your right to opt-out of direct marketing and promotions

AMB provides an opt-out for marketing emails in every communication sent. You may opt out of any communication sent by AMB at any time by emailing AMB to inform her you no longer wish to be on the mailing list and hear about the services being provided. If you are a repeat customer, we retain a record of your class visits and activities as well as relevant health and fitness information relating to the services we provide. This data is collected to give you the best service possible and in order to tailor our products to customer needs more accurately in the future.

General data AMB monitors

AMB may collects information about customers using excel. This information includes data purchase history and attendance. This information is used only by AMB to improve AMB’s products and services. AMB does not pass on or sell this information to any third parties.

Access to your information and corrections

You have the right to request a copy of the information that AMB holds about you. If you would like a copy of some or all of your personal information, please email AMB at: info@ambphysio-pilates.co.uk. AMB wants to make sure that your personal information is accurate and up to date. You may ask AMB to correct or remove information you think is inaccurate.

Changes to this Privacy Policy

AMB keeps this Privacy Policy under regular review and any changes will be emailed to you. This privacy policy was last updated 02/11/2023.

AMB Physio Pilates Disclaimer

DISCLAIMER: Always consult your GP and/or any health care professional, under whose supervision or care you may currently be under before participating/performing exercise or any other fitness class for your own safety. Consulting your GP or health care professional is recommended in order to determine if this type of exercise is right for your physical condition and personal needs. By participating in the exercises, you are performing them at your own risk. You should understand that when participating in any exercise or exercise class, including Pilates, there is the possibility of physical injury. During the Pilates classes there will be use of latex resistance bands and this is done at your own risk and the use of eye protective equipment is recommended when using these bands.

If you engage in any of these Pilates classes, you agree that you are doing so only after obtaining approval from your GP or health care professional and considering and disclosing to your Pilates instructor all your personal risks and conditions that you are aware of prior to beginning each class. Common risks include, but are not limited to: risk of injury, aggravation of a pre-existing condition, or adverse effect of over-exertion such as muscle strain, abnormal blood pressure, fainting, disorders of heart beat, and very rare instances of heart attack. As with any exercise programme, if at any point during the class you begin to feel faint, dizzy or have any physical discomfort, you should stop immediately and seek medical advice. Please use good judgement and common sense when taking the class, consider your level and ability, how you feel on that particular day and choose the appropriate level of the exercises. Rest when you need to. Please also ensure you are in a clear space with no obvious hazards, with ventilation, appropriate lighting and access to water.

You agree that you are voluntarily participating in these activities, assume all risk of injury to yourself, and agree to release and discharge Ann-Marie Ballantine from any and all losses, liabilities, injuries or damages resulting from any and all claims to the fullest extent allowed by English law. Should any part of this Disclaimer be found to be unenforceable or void under English law, or any other jurisdiction, that part shall be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions. Any such prohibition or unenforceability in any jurisdiction as to any part of this Disclaimer shall not invalidate or render unenforceable such provision in any other jurisdiction.

By taking part in any class you are confirming that you have read, understood and agree to all parts of this Disclaimer and agree to follow the instructor’s instructions and guidance during each class.

By completing the Initial Health Questionnaire and/or attending any class you understand and agree to all of the above in the Disclaimer and AMB Physio Pilates’ Privacy Policy.
